Big win for our Resnick & Louis team in New York! Partners Scott Goldstein and Kelly Griffin-Fromm, Esq. secured a significant court decision, allowing us to compel a further deposition of the Plaintiff. This case unveils serious allegations of a fraudulent scheme involving both Plaintiff’s treating doctors and counsel, recently named in separate civil RICO actions. Judge Laura Douglas concluded that under these circumstances, Plaintiff “must submit to a further deposition”. More significantly, Judge Douglas expressly held that the attorney-client privilege could not be invoked to preclude testimony of such communications between Plaintiff and his counsel that “may have been in furtherance of a fraudulent scheme or other wrongful conduct”. This victory strengthens our defense strategy, enabling deeper insight into critical attorney-client communications tied to these alleged fraudulent practices.
