Jim Abraham is a Partner working out of the Phoenix office of Resnick & Louis, P.C. Jim’s extensive experience over his forty-three (43) year career working for both plaintiffs and defendants has enriched him with an understanding of what legal steps need to be taken for or against each party to achieve a reasonable settlement or a successful jury trial outcome.
Since 1986, Jim has tried ninety-one (91) injury jury trials to jury verdict, which have included five wrongful death cases. He has tried fifty (50) trials for the defense and forty-one (41) trials for the plaintiff. Jim has tried jury trials throughout Southern Arizona in the Counties of Pima, Maricopa, Pinal, Cochise, Santa Cruz, Gila and Yuma.
Jim’s jury trials have involved a plethora of liability issues, with a sampling including: individual and commercial motor vehicle operation and maintenance, school bus loading, road maintenance and signing, product liability (co-efficient of friction for outdoor sidewalk sealant, modification of guard on machine power take off), uneven walking surfaces in commercial/retail buildings, police use of force (chokehold use, and code 3 pursuit), dog attacks, and a horse’s delayed refusal to load at the Tucson Rodeo Parade.
Jim’s jury trials have involved many trauma injuries, including: spinal anatomy injuries, disc herniations/aggravations, peripheral nerve injury, traumatic brain injury (TBI), seizures (organic and non-organic), PTSD, pain management, peripheral joint fractures, “soft tissue” strain/sprain, degloving, partial quadriplegia, eye injury, remediation of scars, wage loss, loss of earning capacity, cost of future medical care, cost of future care reduced to present value, vocational rehabilitation, depression, and future psychological care.
These diverse cases have allowed Jim to work with the best medical and scientific experts in the field of medicine. When liability issues are disputed, when feasible, Jim prefers to find and develop a local expert, who juries usually find more credible than out-of-state, professional liability experts. Jim developed and worked with local experts for the trials involving police use of force, dog attacks, and horse wrangling. As part of Jim’s representation of state-chartered municipal corporations, eight (8) of Jim’s jury trials involved a law enforcement officer acting while on duty.
Jim has successfully litigated claims made by and against insurance carriers, including non-injury claims involving claim handling and case evaluation, subrogation, contract disputes, indemnification between carriers, fraudulent injury claims.
On behalf of insurance companies, Jim has litigated cases against unlicensed providers which were diagnosing and treating injury claimants with non-research supported, and unapproved treatments, therapies, and testing devices, and/or have asserted unreasonable claims for payment.
Jim is licensed to practice law in the state of Arizona, U.S. District Court, Arizona U.S. Court of Appeals, 9th Circuit, and the following Tribal Courts: Pascua Yaqui, Tohono O’Odham, White Mountain Apache, Cocopah, Gila River
